StreaMonkey GmbH, hereinafter referred to as “streaMonkey”, “we” or “us”, takes the protection of your data very seriously and treats your personal data confidentially and in accordance with the statutory provisions, in particular the GDPR and the TTDSG. In this privacy policy, we inform you about the type, scope and purpose of the collection and use of this data by us on this website.

2.1 Collection of personal data when visiting the website
information is automatically transmitted to the server of our website by the browser used on your end device. This information is only stored temporarily in a so-called log file. The following information is collected without any action on your part and stored until it is automatically deleted
- IP address of the requesting system,
- Date and time of access,
- Name and URL of the retrieved file,
- Website from which access is made (referrer URL),
- browser used and, if applicable, the operating system of the requesting system
The aforementioned data is processed by us for the following purposes
- Ensuring the smooth structure and function of our website
- Analysing system security and stability
- For further administrative purposes
The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest follows from the purposes for data collection listed above and lies in being able to make our website available to you so that we can introduce ourselves to you. Under no circumstances do we use the data collected for the purpose of drawing conclusions about your person.
2.1.1 Cookies when visiting the website
We also use cookies on our website. Cookies are small text files that are automatically created and stored on your end device. Most cookies are deleted immediately after the end of the browser session (so-called session cookies). There are also other cookies that remain stored on your computer until you delete them. These cookies enable us to recognise your browser the next time you access our website.
We use cookies to make our website more user-friendly, secure and effective, to statistically record the use of our website and to further optimise our website. The legal basis for the use of cookies for the aforementioned purposes is Art. 6 Para. 1 lit a GDPR in conjunction with §25 TTDSG and/or 6 Para. 1 S.1 lif. f GDPR in conjunction with §25 Para. 2 TTDSG.
You have the right to withdraw your consent at any time. This does not affect the lawfulness of the consent to the processing of your personal data given prior to the revocation.
Cookies are usually accepted automatically by your browser. However, you have the option of setting your browser so that no cookies are stored on your computer. However, completely deactivating cookies may mean that you cannot use our website optimally.
2.1.2 Matomo analysis service
This website uses the open source web analysis service Matomo. Matomo uses technologies that enable the cross-page recognition of the user to analyse user behaviour (e.g. cookies or device fingerprinting). The information collected by Matomo about the use of this website is stored on our server. The IP address is anonymised before storage.
The use of this analysis tool is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the anonymised analysis of user behaviour in order to optimise both its website and its advertising. If a corresponding consent has been requested (e.g. consent to the storage of cookies), the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR; the consent can be revoked at any time.
The information collected by Matomo about the use of this website is not passed on to third parties. You have the option here to prevent actions you take here from being analysed and linked. This will protect your privacy, but will also prevent the owner from learning from your actions and improving usability for you and other users.
2.2 Collection of personal data when contacting us
For questions of any kind, we offer you the opportunity to contact us via the e-mail address hello@streamonkey.de. It is necessary to provide a valid e-mail address. Further information can be provided voluntarily. Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntarily given consent. The personal data collected by us during communication will be deleted immediately after your enquiry has been dealt with, unless we are obliged to retain it for 10 years due to tax law requirements (§ 147 para. 3 AO).
2.3 Collection of personal data when submitting applications
If you send us an application, we will process all personal data contained therein.
In particular, these are the data on contactability:
- Surname, first name
- address
- e-mail address
- telephone number
- CV
- Certificates, references
The processing is based on our legitimate interest in accordance with Art. 88 GDPR in conjunction with §26 BDSG to be able to offer you a job with us and to check whether your data can be matched with the requirements of the vacancy. Applications will be deleted or destroyed after 6 months.
2.4 Collection of personal data when accessing a stream on our streamonkey.de and streamonkey.net platform
When you connect to a stream via our platform streamonkey.de and streamonkey.net, the following personal data is stored in a log file and processed by us:
- Stream accessed
- Date and time of the call
- Type of the requesting system
- IP address of the requesting system
- Listener ID, unique identifier created by the app used or the requesting player and transmitted to us
- depending on the integration of the player, Socal Login
The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR (legitimate interest) and Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntarily given consent.
Our legitimate interest lies in the provision of streaming services for media broadcasters in order to be able to develop our business model. In doing so, streaMonkey GmbH acts as a processor and processes personal data exclusively on behalf of the controller of a customer/third party.
The storage of personal data is subject to valid market standards for us and our customers, which make further processing of the data necessary for web radio measurements. In particular, the media analysis “ma IP Audio” of the Arbeitsgemeinschaft Media-Analyse e.V. (AMGA), which summarises current figures on the use of online audio offerings for national comparability, planning and bookability, is decisive. Further information on data collection for web radio measurement and the specification can be found at AGMA and in section 2.4.2.
In compliance with data economy and the requirements for web radio measurement, the personal data is stored in our log files for 3 months, after which it is automatically anonymised.
2.4.1 Cookies when calling up a stream
A so-called technical cookie is created when a stream is called up. This technical cookie does not contain any personal data and makes no reference to natural persons. It stores a pseudonymised session ID and the reference for the display of current stream metadata (title, artist), which is used for quality assurance purposes and to optimise the user experience.
2.4.2 Forwarding of data
The data stored in the log file will be forwarded to the offices listed below for evaluation of listening behaviour as required. An order processing contract has been concluded with each of these organisations to safeguard their rights.

Furthermore, the listener ID is passed on to third parties for advertising purposes. There is no other transfer of personal data.
2.5 Collection of personal data when providing further platform services
Our customers are provided with additional services for analysing the streamed content. As a rule, an e-mail address is used for login. We do not process any other personal data in the customer portal. The processing of the e-mail address is carried out in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR for the fulfilment of the contract and on the basis of a legitimate interest in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR. The legitimate interest lies in a smooth business process. The e-mail address for further platform services is stored until the end of the contractual relationship. It will be deleted after the end of the contractual relationship.
3. Your rights
3.1 Right to information in accordance with Art. 15 GDPR
You have the right to request information about the personal data processed by us. In particular, you can request information about the purposes of processing, the categories of personal data that are processed, the recipients or categories of recipients to whom the personal data have been or will be disclosed, the planned storage period or, if this is not possible, the criteria for determining this period, the existence of a right to rectification or erasure of the personal data concerning you, the existence of a right of appeal to the supervisory authority, the origin of the data if it was not collected by us and the existence of automated decision-making including profiling.
3.2 Right to rectification pursuant to Art. 16 GDPR
You have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you or the completion of incomplete personal data.
3.3 Right to erasure pursuant to Art. 17 GDPR
You have the right to obtain from us the erasure of personal data concerning you without undue delay, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.
3.4 Right to restriction of processing pursuant to Art. 18 GDPR
You have the right to obtain from us restriction of processing if you contest the accuracy of the personal data, the processing is unlawful but you do not request erasure, we no longer need your data for the purposes of the processing, but you still need it for the establishment, exercise or defence of legal claims or you have objected to processing pursuant to Art. 21 (1) GDPR.
3.5 Right to data portability pursuant to Art. 20 GDPR
You have the right to receive the personal data concerning you from us in a structured, commonly used and machine-readable format and to request the transmission of this data to another controller.
3.6 Right to withdraw consent pursuant to Art. 7 para. 3 GDPR
You have the right to withdraw your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
4. Right to object pursuant to Art. 21 GDPR
You have the right to object to the processing of your personal data if it is processed by us on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. e or f GDPR and if there are reasons for this arising from your particular situation.
We will no longer process your personal data after you have objected, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
Where personal data are processed for direct marketing purposes, you as the data subject have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.

5. Complaint right Art. 77 GDPR
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority. This is usually the supervisory authority at your usual place of residence, your place of work or our registered office.
6 Changes to the data protection declaration
The further development of our website or new legal or official data protection requirements may make it necessary to amend this privacy policy. We therefore reserve the right to amend the privacy policy at any time as necessary.
